These Terms of Service ("Terms") govern your use of Agent DM ("Service"), operated by Agent DM ("we," "us"). By accessing or using the Service you agree to these Terms.

1. Use of the service

Agent DM grants you a limited, non-exclusive, non-transferable right to use the Service for lawful outbound messaging purposes. You must be 18 or older and have authority to bind yourself or your organization to these Terms.

2. Acceptable use

You agree not to use Agent DM to:

• Send spam, unsolicited bulk messages, or harassing content
• Violate the terms of service of any connected platform (LinkedIn, X, Instagram)
• Impersonate any person or entity
• Distribute malware, phishing links, or fraudulent content
• Violate any applicable law or regulation
• Circumvent platform rate limits or security measures

You are responsible for all messages sent through your account. Agent DM generates content for your review — you approve what gets sent.

3. Account responsibility

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

4. Subscription and billing

Paid plans are billed monthly. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months. All prices are in USD and exclude applicable taxes.

5. Intellectual property

You retain ownership of content you provide to the Service. You grant Agent DM a license to use your content solely to provide the Service. Agent DM retains all rights to its software, technology, and brand.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. We do not guarantee specific reply rates, deliverability outcomes, or platform availability. Platform API changes may affect service functionality.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENT DM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Termination

We may suspend or terminate your account for violation of these Terms, with or without notice. You may cancel your account at any time from your dashboard settings.

9. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

10. Changes

We may update these Terms. We'll notify you of material changes by email. Continued use of the Service after changes constitutes acceptance.
